Welsh Government gives Natural Resources Wales £19m to pay tax bill

The Welsh Government has allocated £19 million to Natural Resources Wales (NRW) amidst an ongoing investigation by HMRC concerning tax compliance. NRW, a substantial body with 2,000 employees sponsored by the Welsh Government, plays a crucial role in addressing environmental challenges such as climate, nature, and pollution emergencies. The inquiry by HMRC focuses on NRW’s adherence to off-payroll working regulations, also known as IR35 requirements, aimed at ensuring comparable payment of Income Tax and National Insurance as that of an employee.

Despite NRW’s financial accounts indicating a potential liability of £19 million without admitting any fault, the organisation has made the payment to HMRC. There is a possibility that the amount, together with accrued interest, might increase. The terms for repaying the Welsh Government are yet to be finalised, and NRW may potentially reduce the sum over several years or utilise income from fines and licences.

In the previous financial year, NRW saw an increase in expenditure to £300 million, with staff costs rising due to pay rises and the delivery of projects, despite a decrease in staff numbers. The organisation is devising budget plans to save £13 million in the upcoming financial year, leading to 265 job losses. Welsh Minister for Climate Change and Rural Affairs, Huw Irranca-Davies, emphasised ongoing discussions between NRW and HMRC to reach a resolution, with the Welsh Government committed to supporting NRW throughout the process.

Welsh Conservative MS James Evans expressed concerns over the investigation and potential financial implications for NRW, urging for a critical evaluation of the organisation’s operations. NRW, in response, mentioned in their accounts the steps taken regarding the HMRC investigation, with a £19 million payment made as a precautionary measure. The ongoing discussions are expected to influence the final outcome as NRW and HMRC work towards resolution.
