A British mum, Natalie Saunders, is caught in a legal dilemma after taking her daughter on holiday during school term time. The 44-year-old risk and compliance worker faces the prospect of a criminal conviction and a hefty fine, which could jeopardize her career. Natalie and her eight-year-old daughter, Ava Martin-Saunders, embarked on a trip to Bodrum, Turkey, in May, fully aware that the absence from school would be marked as unauthorised, potentially resulting in a £60 fine.
Upon their return, Natalie claims she did not receive the penalty fine notice through post and assumed she had escaped the fine. However, she was shocked to receive a letter from West Sussex County Council in August, stating she had failed to pay the fine and could face legal action. The council has charged her under Section 444 (1) of the Education Act 1996, which penalises parents if their child of compulsory school age fails to attend regularly. Natalie is required to prove a “reasonable justification” for her daughter’s absence.
Despite her attempts to communicate with the council and pay the fine late, the amounts were refunded to her account. Natalie expressed her distress at the situation, fearing the implications on her career and reputation. She criticised the system where she is expected to prove she did not receive the fine notice, rather than the council proving they sent it. Natalie claims she made efforts to address the issue, highlighting postal service problems in her area, but the council remains adamant on legal proceedings.

Natalie’s Crawley Labour MP, Peter Lamb, raised concerns over the council’s decision to pursue legal action despite Natalie’s willingness to pay the fine. The MP emphasised the potential impact on her child’s well-being and criticised the council for escalating the matter, risking taxpayer money in the process.
