A shocking incident of violence has left an engineer unable to work after sustaining serious injuries in an unprovoked attack in broad daylight. The attack occurred on a summer’s day when Nicholas Summerhayes, 55, and his son, Sam Summerhayes, 26, assaulted the victim, causing him to suffer a fractured rib and a punctured lung. The distressing incident took place at Cardigan Court in Newport, with the victim, Gareth Smith, and his partner Chloe Hughes becoming the unfortunate targets of the brutal assault.
According to the prosecutor, Pamela Kaiga, the attack unfolded on July 1, 2023, at midday when Gareth Smith and Chloe Hughes returned home after getting food. As they sat in their car, a minor dispute with Nicholas Summerhayes escalated quickly, leading to a barrage of verbal abuse and threats directed at the couple. The situation turned violent when Sam Summerhayes joined his father and physically attacked Mr. Smith, causing him severe injuries as he attempted to flee the scene.
The repercussions of the assault were severe for the victim, Mr. Smith, who suffered not only physical injuries but also emotional trauma. The incident left him with a fractured rib, a punctured lung, and various bruises and abrasions on his body. In addition to the physical pain, Mr. Smith revealed that he now struggles with anxiety, exacerbated symptoms of ADHD and Asperger’s, and faces difficulties in carrying out everyday tasks due to his injuries.
During the court proceedings, it was disclosed that both Nicholas and Sam Summerhayes had previous criminal records, with histories of drug-related offences. However, their legal representatives highlighted that the defendants were remorseful for their actions and expressed a willingness to reform their behaviour. Nicholas Summerhayes, in particular, had made significant strides in turning his life around by abstaining from drugs and alcohol and contributing positively to his community through a mentoring role.
In his sentencing remarks, Recorder Paul Lewis KC condemned the violent nature of the attack, describing it as “appalling” and acknowledging the severe consequences it had on the victim. Despite the gravity of the offence, both Nicholas and Sam Summerhayes were handed a suspended prison sentence, with additional requirements for rehabilitation programmes and restraining orders against the victim and his partner.
