Expert issues headlight warning that could see drivers hit with £5,000 fine and nine penalty points

An expert has raised concerns about headlight usage that could potentially lead to drivers facing a hefty £5,000 fine and receiving nine penalty points on their license. As we approach the darker months of autumn and winter, driving conditions become more challenging. Slippery roads due to wet and windy weather, combined with earlier nights, increase the likelihood of accidents. While many drivers may be aware of these risks, they may not be fully informed about the financial penalties associated with driving in the dark.

Under section three of the Road Traffic Act of 1988, drivers can be penalised for flashing or dazzling other motorists with their full beam headlights. Such actions are considered inconsiderate driving and are subject to significant fines and penalty points. The law states that driving without due care and attention or consideration for others on the road is an offence. Infringing this rule, such as by flashing headlights, could result in fines of up to £5,000, along with potential penalty points or a community payback order. Courts do not have the authority to impose custodial sentences for drivers convicted of careless driving.

Not only can flashing headlights be a violation of the Road Traffic Act, but it also goes against Rule 114 of the Highway Code. The code stipulates that drivers must not use lights in a way that could dazzle or cause discomfort to other road users. Therefore, flashing lights inappropriately is discouraged, and the purpose of flashing headlights should only be to indicate presence and not to intimidate or convey other messages. Along with penalties, drivers engaging in careless or inconsiderate driving, such as dazzling others with full beam headlights, could face additional consequences such as penalty points and fines. The legislation outlines various actions that fall under careless driving, including undertaking vehicles, driving too closely, ignoring traffic signals, and committing other unsafe practices.
