Driver Found Not Guilty of Dangerous Driving in Fatal Collision
A driver involved in a tragic accident that resulted in the death of another motorist has been acquitted of causing death by dangerous driving. Dale Groves, aged 29, accepted responsibility for the death of Gareth Davies due to careless driving. The incident occurred on April 13, 2023, on Fochriw Road in Merthyr Tydfil, where Groves’ white Ford Ka collided with Davies’ black Renault Clio during an overtaking manoeuvre near Biffa Waste Management in Trecatti.
During the trial at Newport Crown Court, Prosecutor Ieuan Bennett described the events leading up to the crash as “sad and disturbing”. A convoy of three vehicles was travelling along the road, with an oil tank lorry at the front, followed by Davies’ Renault and Groves’ Ford at the rear. The court heard that Groves repeatedly attempted to overtake the vehicles before the fatal collision occurred as Davies was turning right into the Biffa site.
It was revealed that professional driver Jamie Cummings was driving the tanker at a speed of around 25mph and was unaware of Davies’ car due to a blind spot. However, Groves’ attempts to overtake were observed by Cummings. As the vehicles approached the landfill site, Groves accelerated and collided with Davies’ car, resulting in fatal injuries for Davies. Despite Groves’ efforts to assist after the crash, Davies could not be saved.
Testimony during the trial indicated that Davies had slowed down to between five and nine miles per hour to make the right turn, while Groves was travelling at approximately 46 to 50mph in a 60mph zone. Following the collision, Groves made multiple emergency calls for assistance, but Davies was pronounced dead at the scene.
In court, Groves expressed deep remorse for the tragic outcome, acknowledging his responsibility in the incident. He admitted to taking a risk by attempting the overtaking manoeuvre and failing to perceive the potential danger of Davies making a turn. Despite being found not guilty of causing death by dangerous driving, Groves had previously pleaded guilty to causing death by careless driving.
Groves, a resident of Alfred Street in Penydarren, Merthyr Tydfil, has been granted bail until his sentencing hearing on May 2. The case serves as a sobering reminder of the consequences of reckless driving and the importance of exercising caution on the road to prevent such devastating incidents from reoccurring.
